Terms of Service

These Terms of Service ("Terms") govern your use of envyrofax.com and related services (the "Service") operated by Envyrofax ("Envyrofax," "we," "us"). By using the Service or creating an account you agree to these Terms. If you do not agree, do not use the Service.

1. What Envyrofax is

Envyrofax compiles publicly available government records (for example from the EPA, CDC, NCI, FEMA, NOAA, USGS, USDA and the Department of Transportation) about the area around a U.S. address and presents them with scores, maps and summaries. Envyrofax is an informational tool. It is not a home inspection, a Phase I or II environmental site assessment, an appraisal, a survey, legal advice, medical advice, a diagnosis or a guarantee about any property or person. 2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You agree to give accurate information when you create an account, to keep it current, and to keep your sign-in codes private. You are responsible for activity under your account. We may suspend or close accounts that violate these Terms, abuse the Service, or use false information.

3. Free service and advertising

The Service is currently provided free of charge and is supported by advertising. We may introduce paid features in the future; we will tell you before you are charged for anything, and nothing will be charged without your express agreement.

4. Acceptable use

• Do not scrape, crawl or bulk download the Service or its reports except through features we provide, and do not overload or disrupt it.
• Do not use the Service to make decisions about a person's eligibility for credit, insurance, employment, housing or any purpose covered by the Fair Credit Reporting Act. Envyrofax is not a consumer reporting agency and reports describe places, not people.
• Do not use the Service to harass, stalk or harm anyone, or to misrepresent a report as an official government finding or a professional assessment.
• Do not attempt to access accounts or data that are not yours, or to bypass security or rate limits.

5. Data accuracy

Government datasets contain errors, gaps, delays and location inaccuracies. Scores and signals are generated by automated methods described on our methodology page and may change as data is updated. We do not warrant that any report is complete, current or accurate. Verify anything important with the original agency source, a qualified professional, or a test of the property.

6. Intellectual property

The underlying government data is generally in the public domain. The Service itself, including its design, software, scoring methods, text, graphics, 3D models and branding, is owned by Envyrofax and protected by law. You may view and share reports for personal, non-commercial use with attribution to Envyrofax. Map data is provided by OpenStreetMap contributors under the Open Database License.

7. Third-party links and ads

The Service shows advertising and links to third-party sites, including agency sources. We are not responsible for third-party content, products or practices. Advertisements are not endorsements.

8. Disclaimer of warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ENVYROFAX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, PROPERTY VALUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS. Some jurisdictions do not allow these limits, so they may not apply to you.

10. Indemnity

You agree to defend and indemnify Envyrofax against claims arising from your misuse of the Service or violation of these Terms.

11. Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Palm Beach County, Florida, and you consent to that jurisdiction, except that either party may bring an individual claim in small claims court.

12. Changes

We may update these Terms. If a change is material we will notify account holders by email or on the Service before it takes effect. Continued use after the effective date means you accept the updated Terms.
